These Terms of Service (the “Terms”) govern access to and use of XEZEZ.COM (the “Platform”), including its website, browser-based games, user accounts, ratings, favourites, comments, articles, and other features or services made available through it.

The Platform is provided by:

Provider: Maryna Dushkevych
Location: Lublin, Poland
Email: xezezcom@outlook.com
Contact form: https://xezez.com/contact-us

The Provider may also be referred to in these Terms as “we,” “us,” or “our.”

By accessing or using the Platform, you agree to comply with these Terms. If you create an account, you expressly accept these Terms as part of the registration process.

If you do not agree with these Terms, you must not create an account and should discontinue use of the Platform.

These Terms also constitute the rules governing the provision of electronic services through the Platform to the extent required by applicable Polish law.

1. Scope of the Platform

The Platform provides users with access to a catalogue of browser-based games and related content.

Depending on the particular game or feature, content may:

  • run directly within the Platform;

  • be embedded from a third-party service;

  • use resources hosted by a third party;

  • redirect users to an external website;

  • be supplied, owned, or operated by an independent game developer, publisher, distributor, or other third party.

The Platform may also provide, among other things:

  • game descriptions and instructions;

  • game categories and search functionality;

  • player ratings;

  • favourites;

  • related-game recommendations;

  • editorial recommendations;

  • user comments;

  • articles and blog content;

  • publisher or developer information;

  • videos, images, or other media; and

  • other functions introduced from time to time.

Unless expressly stated otherwise, access to the Platform itself is provided free of charge.

Third-party services accessible through the Platform may be subject to separate terms, privacy policies, payment arrangements, or other conditions imposed by their respective providers.

2. Electronic Services

The Provider may make the following electronic services available through the Platform:

  1. access to publicly available Platform content;

  2. access to browser-based games;

  3. user account registration and management;

  4. saving games to favourites;

  5. submitting ratings;

  6. submitting comments or other permitted user contributions;

  7. use of search, browsing, recommendation, and category functions;

  8. access to articles, guides, and other editorial content;

  9. communication with the Provider through available contact methods; and

  10. other services or functionality made available through the Platform.

For services that do not require registration, an agreement for the provision of an electronic service is concluded when the user begins using the relevant functionality and ends when the user ceases using it.

For services requiring an account, the agreement is concluded when registration is successfully completed and remains in force until the account is deleted or the agreement is otherwise terminated in accordance with these Terms.

3. Technical Requirements

To use the Platform, users generally require:

  • a device capable of connecting to the Internet;

  • an active Internet connection;

  • a reasonably current web browser;

  • JavaScript enabled where required;

  • support for cookies, local storage, or similar browser technologies where necessary for a particular function.

Certain games may additionally require:

  • keyboard or mouse controls;

  • touchscreen capability;

  • sound output;

  • fullscreen functionality;

  • a particular screen orientation;

  • specific browser capabilities; or

  • other hardware or software features.

Individual games may have different technical requirements because they may originate from independent developers or publishers.

The Provider does not guarantee compatibility with every browser, operating system, device, hardware configuration, browser extension, privacy tool, ad blocker, script blocker, or network configuration.

Users are responsible for their own devices, Internet connections, software, and any associated charges.

4. User Accounts

Certain features of the Platform may require registration.

When creating or maintaining an account, you agree to:

  • provide accurate information where requested;

  • keep your login credentials confidential;

  • use reasonable measures to secure your account;

  • not share your account in a manner that creates a security or abuse risk;

  • not impersonate another person or entity;

  • not create an account for fraudulent, unlawful, or abusive purposes; and

  • notify the Provider if you reasonably suspect unauthorized access to your account.

You are responsible for activity carried out through your account to the extent permitted by applicable law.

Display names, usernames, and other account identifiers must not:

  • impersonate another person;

  • falsely imply affiliation with the Provider or another organization;

  • violate third-party rights;

  • contain unlawful content; or

  • be used for harassment, fraud, or abuse.

The Provider may require an account identifier to be changed where reasonably necessary for legal, security, moderation, or operational reasons.

5. Minors

The Platform may contain games or content that are not suitable for all age groups.

Users who have not reached the age at which they may independently enter into agreements or consent to relevant data processing under applicable law should use the Platform only with the involvement or authorization of a parent or legal guardian where legally required.

Parents and guardians are responsible for assessing whether particular games or content are appropriate for minors under their supervision.

The availability of a game on the Platform does not constitute a representation that the game is suitable for children or for any particular age group.

6. Third-Party Games and Services

Some games, advertisements, videos, software, links, media, or other materials accessible through the Platform may be provided, hosted, operated, or controlled by third parties.

Such third parties may apply their own:

  • terms and conditions;

  • privacy policies;

  • cookie practices;

  • advertising practices;

  • payment terms;

  • age restrictions; and

  • technical requirements.

When you access third-party content or follow an external link, you may leave an environment controlled by the Provider.

The Provider does not control independent third-party services and does not guarantee their:

  • availability;

  • legality;

  • accuracy;

  • security;

  • reliability;

  • suitability;

  • quality;

  • continued operation; or

  • compatibility with your device.

Users should exercise appropriate caution before providing payment details, passwords, identity information, or other sensitive information to third parties.

7. Intellectual Property

The Platform and its original elements, including its branding, layout, design, original text, editorial content, organization, and proprietary software components, may be protected by copyright, trademark, database, and other intellectual property laws.

Games, logos, artwork, trademarks, names, videos, screenshots, software, and other materials supplied by third parties remain the property of their respective owners or licensors.

Unless expressly authorized by law or by the relevant rights holder, users must not:

  • reproduce substantial parts of the Platform;

  • copy or redistribute protected content;

  • sell, sublicense, or commercially exploit Platform content;

  • remove copyright, trademark, attribution, or ownership notices;

  • circumvent technical protection measures;

  • falsely claim ownership of content belonging to another party; or

  • use protected materials in a manner that infringes intellectual property rights.

Nothing in these Terms transfers ownership of the Platform, any game, or any third-party intellectual property to a user.

8. User Content

For the purposes of these Terms, “User Content” includes comments, display names, messages, and other content submitted by users for publication or display through the Platform.

You retain any intellectual property rights that you hold in your User Content.

By submitting User Content, you grant the Provider a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, moderate, and technically process that content to the extent reasonably necessary to:

  • operate the Platform;

  • display the content;

  • perform moderation;

  • enforce these Terms;

  • prevent abuse or security incidents;

  • comply with legal obligations; and

  • resolve complaints or disputes.

This license continues for as long as the relevant User Content is hosted through the Platform and for any additional period during which retention is reasonably necessary for legal compliance, security, dispute resolution, or backup purposes.

You represent that you have the legal right to submit your User Content and that doing so does not unlawfully infringe the rights of another person.

9. Acceptable Use

Users must use the Platform lawfully and in accordance with these Terms.

You must not use the Platform to create, submit, distribute, promote, facilitate, or transmit content or conduct that:

  • is unlawful;

  • infringes copyright, trademark, privacy, publicity, or other rights;

  • contains malware, viruses, malicious code, or harmful scripts;

  • facilitates fraud, phishing, credential theft, or deception;

  • unlawfully discloses personal or confidential information;

  • constitutes unlawful harassment or credible threats;

  • exploits or endangers minors;

  • unlawfully promotes or facilitates criminal activity;

  • constitutes spam or deceptive advertising;

  • fraudulently manipulates ratings, comments, votes, traffic, or statistics;

  • impersonates another person or organization;

  • falsely suggests endorsement by or affiliation with the Provider;

  • circumvents access controls, moderation systems, or security measures;

  • interferes with the normal functioning of the Platform; or

  • otherwise violates applicable law.

Users must not attempt to gain unauthorized access to the Platform, its infrastructure, user accounts, databases, or connected systems.

Users must also not intentionally overload, disrupt, attack, damage, reverse engineer where prohibited by law, or compromise the security or integrity of the Platform.

10. Ratings

The Platform may permit users to rate games.

Ratings reflect the opinions or actions of users and do not constitute guarantees or representations by the Provider concerning the quality, safety, reliability, suitability, or performance of any game.

The Provider may implement technical or organizational measures intended to detect or reduce fraudulent, automated, duplicate, or manipulated ratings.

Ratings may be removed, disregarded, or adjusted where there is reasonable evidence of manipulation, abuse, technical error, or violation of these Terms.

11. Comments and Content Moderation

Comments or other User Content may be reviewed before or after publication.

The Provider may use manual moderation as well as reasonable technical or automated tools for purposes such as:

  • spam detection;

  • abuse prevention;

  • fraud prevention;

  • duplicate detection;

  • security;

  • identification of potentially unlawful content; and

  • prioritization of content for human review.

Where content violates these Terms or applicable law, the Provider may take proportionate action, including:

  • rejecting content before publication;

  • removing content;

  • restricting visibility;

  • requesting modification;

  • limiting access to particular features;

  • issuing warnings;

  • temporarily suspending an account; or

  • terminating an account.

When determining an appropriate measure, the Provider may consider factors including:

  • the nature and severity of the violation;

  • the potential harm caused;

  • whether the conduct is repeated;

  • the user's previous conduct;

  • risks to other users;

  • legal requirements; and

  • the security and integrity of the Platform.

Where required by applicable law, affected users will be provided with information concerning moderation decisions and available means of review.

The Provider is not obligated to publish every submitted comment.

12. Reporting Illegal or Infringing Content

If you believe that content available through the Platform is illegal or infringes your rights, you may notify the Provider by:

Email: xezezcom@outlook.com

or by using the:

Contact form: https://xezez.com/contact-us

A notice should, where reasonably possible, include:

  1. a description of the allegedly illegal or infringing content;

  2. an explanation of why you believe the content is illegal or infringes your rights;

  3. the specific URL or other information identifying the content;

  4. your contact information, unless applicable law permits or requires otherwise; and

  5. a statement that the information supplied is accurate and provided in good faith.

The Provider may request additional information where reasonably necessary to assess the notice.

Reports will be reviewed in accordance with applicable law.

Submitting knowingly false, abusive, or materially misleading notices may constitute misuse of the Platform.

13. Review of Moderation Decisions

A user whose content has been removed, rejected, or restricted, or whose account has been suspended or terminated as a result of a moderation decision, may request review by contacting the Provider.

Requests may be submitted through:

Email: xezezcom@outlook.com

or:

Contact form: https://xezez.com/contact-us

The request should contain sufficient information to identify the relevant content, account, or decision and should explain why reconsideration is requested.

The Provider will review such requests objectively and in accordance with applicable law.

Nothing in this section limits any statutory rights or remedies available to a user.

14. Copyright and Other Rights Complaints

Rights holders who believe that content available through the Platform infringes copyright, trademark rights, or another legally protected right may contact the Provider.

A complaint should, where appropriate, identify:

  • the protected work or right;

  • the allegedly infringing material;

  • where the material appears;

  • the legal or factual basis of the complaint;

  • the complainant's contact information; and

  • any supporting information reasonably necessary to assess the claim.

Where appropriate and legally permitted, relevant information from a complaint may be shared with the user or third party responsible for the affected content.

The Provider does not adjudicate ownership disputes and does not make binding determinations of intellectual property rights.

15. Rankings, Recommendations, and Search Results

The Platform may organize, rank, or highlight games using various criteria.

For example:

  • Most Played may reflect usage or player interest;

  • Top Rated may reflect ratings submitted by users;

  • Recently Added may reflect the date a game was added;

  • Recommended may reflect editorial selection or other recommendation criteria.

The organization and presentation of content may change over time.

Placement, popularity, ratings, recommendations, category inclusion, or editorial selection do not constitute a guarantee that a game will be suitable, secure, enjoyable, accurate, or compatible with a particular device.

Where commercial or sponsored content is displayed, it will be identified where required by applicable law.

16. Platform Availability

The Provider seeks to maintain the Platform in good working order but does not guarantee uninterrupted or error-free availability.

The Platform or individual features may become temporarily or permanently unavailable because of circumstances including:

  • maintenance;

  • software updates;

  • cybersecurity measures;

  • technical failures;

  • hosting problems;

  • network outages;

  • third-party provider decisions;

  • changes in licensing;

  • compatibility changes;

  • legal requirements; or

  • circumstances beyond the Provider's reasonable control.

The Provider may add, modify, reorganize, suspend, replace, or discontinue games, functions, or other elements of the Platform where reasonably necessary.

Where applicable law requires advance notice of a material change, such notice will be provided.

17. Security

Users must not intentionally introduce malware, malicious scripts, unauthorized automated activity, denial-of-service attacks, credential attacks, or other harmful technology into the Platform.

Security vulnerabilities may be reported through:

Email: xezezcom@outlook.com

or:

Contact form: https://xezez.com/contact-us

Users reporting vulnerabilities should act responsibly and must not:

  • access unrelated personal data;

  • intentionally disrupt the Platform;

  • exploit a vulnerability beyond what is reasonably necessary to demonstrate its existence;

  • attempt to extort the Provider; or

  • publicly disclose sensitive technical details before the Provider has had a reasonable opportunity to investigate and address the issue.

18. Privacy and Cookies

The processing of personal data in connection with the Platform is governed by the applicable Privacy Policy.

The Privacy Policy should describe, among other things:

  • categories of personal data processed;

  • purposes of processing;

  • applicable legal bases;

  • retention periods;

  • categories of recipients;

  • use of cookies or similar technologies; and

  • rights available under applicable data-protection law.

The Platform may use cookies, local storage, or similar technologies for purposes including:

  • maintaining login sessions;

  • remembering preferences;

  • preventing repeated or fraudulent interactions;

  • security;

  • analytics;

  • operating embedded content; and

  • providing Platform functionality.

Where consent is legally required for a particular cookie or technology, it should be used only after the required consent has been obtained.

19. Complaints Concerning Electronic Services

Users may submit complaints concerning the operation of the Platform or the provision of electronic services.

Complaints may be submitted through:

Email: xezezcom@outlook.com

or:

Contact form: https://xezez.com/contact-us

A complaint should, where possible, include:

  • information sufficient to identify the user or account, where relevant;

  • a description of the issue;

  • the affected page, feature, or game;

  • the approximate date and time of the issue; and

  • the resolution requested.

The Provider will consider complaints without undue delay and will normally respond within 14 days after receiving sufficient information to assess the matter.

If additional information is required, the Provider may request it from the complainant.

This complaints procedure does not restrict any mandatory consumer rights or legal remedies.

20. Consumer Rights

Nothing in these Terms excludes, limits, or modifies rights that cannot lawfully be excluded or limited.

Users who qualify as consumers may benefit from mandatory protections provided by Polish law, European Union law, and, where applicable, the mandatory laws of their country of habitual residence.

Where applicable law grants consumers rights concerning digital services, conformity, termination, remedies, complaints, damages, jurisdiction, or other matters, those mandatory rights prevail over any inconsistent provision of these Terms.

Consumers may also have access to competent consumer authorities, courts, or legally recognized out-of-court dispute-resolution procedures.

21. Games and Informational Content

Games and editorial materials available through the Platform are provided primarily for entertainment and general informational purposes.

Game descriptions, instructions, publisher information, screenshots, videos, categories, ratings, or other information may:

  • contain errors;

  • become outdated;

  • originate from third parties; or

  • differ from the current version of a particular game.

The Provider does not guarantee that every game will:

  • operate without interruption;

  • work on every browser or device;

  • retain game progress;

  • remain permanently available;

  • be free from third-party advertisements;

  • be suitable for every age group; or

  • function exactly as described by a developer or publisher.

Users should also follow instructions, warnings, and requirements displayed within individual games.

22. Disclaimer and Limitation of Liability

Nothing in these Terms excludes or restricts liability where doing so would be prohibited by applicable law.

In particular, nothing in these Terms limits mandatory consumer protections.

Subject to such mandatory legal requirements, the Provider is responsible for the operation of the Platform but is not responsible for the independent acts, omissions, services, content, systems, or business practices of unrelated third parties merely because such third parties or their content may be accessible through the Platform.

The Provider is not responsible for losses caused exclusively by circumstances outside the Provider's reasonable control, provided that the Provider has complied with applicable legal obligations.

Users are responsible for exercising reasonable care when:

  • following external links;

  • interacting with third parties;

  • downloading files;

  • sharing personal information; or

  • entering payment or login information on external services.

For users acting in the course of business or professional activity, and to the maximum extent permitted by applicable law, the Provider will not be liable for indirect or consequential loss, loss of profit, loss of business opportunity, or loss of business data arising from use of the free Platform.

This business-user limitation does not apply to consumers where prohibited by law.

23. Suspension and Termination

The Provider may restrict, suspend, or terminate an account where reasonably necessary because:

  • the user materially or repeatedly violates these Terms;

  • the account is used for unlawful purposes;

  • the account creates a significant security risk;

  • the account is used for fraud, spam, manipulation, or abuse;

  • action is required by law or a competent authority; or

  • continued operation of the account would create a material risk to the Platform, the Provider, another user, or a third party.

Where appropriate, the Provider may issue a warning or apply a less restrictive measure before terminating an account.

Immediate action may be taken in circumstances involving serious unlawful activity, cybersecurity threats, fraud, risks to minors, serious harassment, or other urgent circumstances.

Where required by applicable law, users will be informed of the reasons for restrictions and of available means of review.

24. User Termination and Account Deletion

Users may stop using the Platform at any time.

A registered user may terminate the agreement concerning their account by using an account-deletion function where available or by contacting the Provider through:

Email: xezezcom@outlook.com

or:

Contact form: https://xezez.com/contact-us

Account termination does not affect rights, obligations, liabilities, or claims that arose before termination.

Certain information may continue to be retained after account deletion where required or permitted for purposes including:

  • legal compliance;

  • fraud prevention;

  • security;

  • dispute resolution;

  • enforcement of rights; or

  • technical backup processes.

Personal data will be handled in accordance with the applicable Privacy Policy and data-protection law.

25. Changes to These Terms

The Provider may amend these Terms where reasonably necessary, including because of:

  • changes to the Platform;

  • introduction of new features;

  • technical or security developments;

  • changes to moderation practices;

  • changes involving third-party integrations;

  • legal or regulatory requirements; or

  • clarification of existing provisions.

The current version of the Terms will be published on the Platform together with the date of the most recent update.

Where required by law, registered users will be informed of material changes through an appropriate method, which may include email, an account notification, or a prominent notice.

Changes will not retroactively deprive users of rights already acquired.

Where affirmative consent is legally required for a particular amendment, continued use alone will not replace such consent.

26. Governing Law

These Terms are governed by the laws of Poland, subject to mandatory legal protections applicable to consumers.

If a user is a consumer habitually resident in another country, that user retains any mandatory protections that cannot lawfully be excluded by contractual agreement.

27. Dispute Resolution and Jurisdiction

Users are encouraged to contact the Provider first in an attempt to resolve disputes informally.

Contact may be made through:

Email: xezezcom@outlook.com

or:

Contact form: https://xezez.com/contact-us

If a dispute cannot be resolved informally, it may be submitted to a court having jurisdiction under applicable law.

Nothing in these Terms requires a consumer to bring proceedings exclusively in Poland if mandatory consumer-jurisdiction rules provide otherwise.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will apply to the maximum extent permitted by law or, where necessary, will be treated as severed.

The validity and enforceability of the remaining provisions will not be affected.

29. No Waiver

A failure or delay by the Provider in exercising a right or enforcing a provision of these Terms does not constitute a waiver of that right or provision.

Any waiver applies only to the specific circumstances in which it is expressly given.

30. Entire Agreement

These Terms, together with the Privacy Policy and any additional rules expressly applicable to a particular service or feature, constitute the agreement governing use of the Platform.

Where additional terms apply to a specific feature, those terms form part of the agreement for that feature.

Mandatory applicable law will prevail over any inconsistent contractual provision.
